Residential Lease Backhome Log Cabins Enterprises, LLC 1940 Backhome Lane Sevierville, TN 37876
This lease agreement, entered into between of (Landlord) Backhome Log Cabins Enterprises, LLC (hereinafter referred to as Landlord) and of Tenant. For good consideration it is agreed between as follows: Landlord hereby leases and lets to tenant the premises described as: (Cabin Name)___________________, Pigeon Forge/Sevierville, TN. This lease shall be for a term of: _________________ commencing on______________ and terminating on_____________. Tenants shall pay Landlord the daily/weekly rate of $___________ during said term and shall pay a deposit of $___________ to hold and reserve said cabin for previously stated term. Deposit is non-refundable due to cancellation by tenant within thirty days of arrival. Check-in is 4 pm (EST)- check-out is 10am (EST). Tenants SHALL NOT allow pets on premises unless agreed to beforehand. If a pet is found to be in cabin, you will be asked and required to vacate the premises and there will be no refunds for time not used, as provided for by the state of TN. TREC Vacation Lodging Commission. If it has been determined that a pet has been in the cabin after check out, there will be a $150.00 fee charged to the credit card on file. Tenant agrees by signing below to all conditions set forth in this agreement. Each cabin is equipped with a lock box with 2 sets of keys. Directions are on the home page of the website. When using Landlord’s private pool, Landlord is not responsible for accident, injury, or death resulting in its use. There is no lifeguard on duty at anytime so SWIM AT YOU OWN RISK. Please limit occupancy to the cabins maximum. Extra cleaning requirements may incur additional fees. All cabins MUST be paid in full 14 days prior to arrival and there will be NO REFUNDS. If not pre-paid we will consider it a cancellation and will attempt to re-rent. If there is a problem with your cabin at check in we will attempt to resolve it as soon as possible or move you to another cabin, if available. There will be NO REFUNDS at check in under any circumstances. Hot tubs are drained, cleaned, and refilled after every check-out, because of this the hot tub may not be up to operating temperature until later in the evening. Never use bath oils or bubble baths in the hot tubs. There will be an extra $50.00 cleaning fee for the hot tubs and it’s components if neglected in this way. Never sit on the hot tub covers, any damages to the hot tub covers will result in a $350.00 replacement fee. HOT TUB WARNING: persons with heart conditions, skin sensitivities, pregnant women and children under the age of 16 SHOULD NOT use a hot tub. There is medical research indicating that being in a hot tub can cause an unsafe drop in a young persons heart rate and can dangerously increase his/her body temperature. Children are also more prone to skin irritation from chemicals in the water. A hot tub is not a swimming pool. Submersing in a hot tub by any person can result in serious eye, ear, and respiratory diseases. Garbage should be disposed of in the appropriate receptacles located outside of the cabin and will be emptied every Tues. & Fri. and after check-out. Firewood is available for purchase October thru March. Make sure no fire is burning in the fireplace each and every time you vacate the premises. During winter months road conditions may require a 4-wheel drive vehicle. There will be no refunds for inability to reach the cabin due to adverse road conditions. If a reservation is cancelled greater than 30 days prior to arrival, there will be a $150.00 cancellation fee imposed. Each cabin has a STARTER supply of toilet tissue and bath soap. Do not remove any furnishing, accessories, or linens from the cabin for any reason. Tenants will be held responsible for any missing or damaged items. No refunds will be given for minor problems with the cabin i.e.: water leaks, hot tub malfunctions, insects, game machines not functioning properly, etc. The game machines are coin operated and only accept quarters. Before check out make sure to place all dishes in the dishwasher and turn it on. By signing below you acknowledge and agree that in using Landlord’s facilities and amenities you do so at your own risk and you will abide by all aspects of this lease agreement. ‘Backhome Log Cabins’, its respective shareholders, officers, directors, employees, and agents shall not be liable for any damages arising from personal injuries sustained by you or you guest in, on or about the premises of any cabin owned or managed by Landlord and/or amenity. You assume full responsibly for any injuries or damages to yourself and/or guests as well as any damages to personal property which occur on or about the premises of any cabin or property owned or managed by Landlord and/or amenities and fully and forever release and discharge Backhome Log Cabins Enterprises, LLC, its respected shareholders, officers, directors, employees, and agent from any and all claims, demands, damages, rights of any action, cause of action, present or future, whether the same be known, anticipated or unanticipated, resulting from or arising out of your use or intended use by you or your guest(s) use of any cabin owned or managed by Landlord and/or amenities. You understand that you are responsible for any damages to the resort, properties and, amenities caused by you or you guest(s). By signing below, you agree and authorize Backhome Log Cabins Enterprises, LLC to charge any outstanding payments for lodging or damages to any property to you credit card on record or billed to your address on record.
